fuzzy bunny asked: I have a commercial lease that expires in January. I am completely paid up until December 1. I have every intention on paying my January rent, it’s just that I don’t want to renew my lease. I have leased another building and want to move in there asap, and out of the current building. I can be in the other building by Thanksgiving.
My question is regarding abandonment. If I empty this store (it’s a small boutique) and move to the new location before January, can I be fined or forfeit my security deposit? I am not sure what it specifies in the lease, but I’ve heard that anything can be put into a lease, it doesn’t necessarily make it legal.
Would it be considered abandonment if I completely honor my financial obligation yet vacate the premises?
Also, am I allowed to take the light fixtures? I have track lighting and have heard that I cannot take the track itself, but that I can take the lights… is this true? Also, what about my sign? It is attached to the side of the building.
Can I take things that are screwed into the wall?
Sorry for asking these seemingly simple questions, I’ve never wanted to move before!

I have a 4 year lease and have not been paying my rent as I am closing down. I owe my landlord more than I can pay. I have a tenant interested in leasing the property but apparently they can’t re-lease the property without me paying him. Will my rent just keep accruing? How long will it take him to realize I have no money? Do you think the premise will just stay empty and being left unpaid?
I just don’t know what will happen.
I’m sure he will send debt collector for his rent but how long will he wait?

Firas O asked: I signed a 5 year commercial lease and after 3 months in business I was forced to close it. The market wasn’t really good for my business here or maybe it was just a wrong time to open a business in this economy.
I would like to know if I have any rights that can protect me from not paying the whole remainder of the lease. I do not have corporation and it’s under my name. I am afraid they might put a lein into the house that I own which my parents live in.
One other thing I thought it was strange is that they never asked for my social security, driver license, tax id or even any financial statements. All they asked for is who will be on the lease and the name of business. The company I leased it from seems like a big property management.
Well that’s sums it up. I am not sure what to do and I can’t afford to pay the remainder of the lease or even pay the rent till they find someone to sublease. Any advice would surely be appreciated.
